The IND (the Dutch government's immigration agency) makes it easy to apply for a residence permit – the forms are readily available and relatively easy to fill in. At the same time, however, the IND makes it easy to get rejected for a residence permit, since it does not provide clear information about whether you actually qualify.

With some application fees exceeding €800, and with all application fees being non-refundable, it's a good idea to get advice before you apply to make sure that you can qualify. While the ways of the IND may seem random or unpredictable to an applicant, they really are not, for the most part. Avocado Legal can evaluate your application in exactly the same way that the IND would and help you get it right the first time. Avocado Legal can also advise you on the best purpose of stay to apply for, as you may be eligible for others than the one that you were planning to apply for.

NOTE: if you have not left your home country yet, it is a good idea to find out what you need to do before you come to the Netherlands. Contact us and we can make an appointment for a consultation by telephone or Skype.

Avocado Legal is qualified to give advice on all aspects of regular immigration law (not asylum), and specializes in the following purposes of stay:

  • same-sex and different-sex marriages and partnerships, and other forms of family reunification
  • continued residence after a marriage or partnership is over
  • the Dutch-American Friendship Treaty (for US citizens wanting to go into business for themselves in the Netherlands)
  • permanent residence permits, with or without the right to stay in other EU countries
  • family members of European citizens who are not themselves European citizens

as well as naturalization (becoming a Dutch citizen).

We can provide incidental advice on other areas of Dutch law as well, particularly employment and family law, but these are not our specialties and we will refer you to another qualified legal professional if necessary.
